There's probably about a million things wrong with you post, I'm sorry if this comes across as rude but I'll try to address the major points. :)

This case has to do with patent infringement not copyright.

Canon have always and continue to make their own firmware releases, do you even know what firmware is? This case has nothing to do with it.

Did you read the patent descriptions that IV LLC (the plaintiff) claims to hold?
These include: "methods of making a semiconductor image sensor" and "Touch screen systems and methods"
These are so broad ranging that these patents probably cover every digital camera producer that operates in the US and probably many other electronics producers. This lawsuit is currently filed against Canon and Olympus but expect more to follow. It seems like sadly another patent troll action since IV don't seem to actually produce anything, they just seek to patent as much as possible and then try to charge others licensing fees if they discover someone is using a process they hold a patent for.

If you want to understand a bit more about this type of case then have a look at patent trolls in more detail:

Actually Patent trolls are a very unfortunate part of doing business in the USA.

Patents elsewhere are much harder to obtain. In the US the principle is (very roughly) patent anything, then fight it out in court. In most of Europe, you have to show quite a lot of proof that you really are patenting something new, novel, and of some worth (been there, done that)

It's why I'm absolutely dead against an EU/US tie up on this matter. We inherit all the US lax patents then end up filling lawyers pockets trying to undo the damage... it would decimate the UKs small and medium businesses who are the mainstay of the UK economy.
